Terms & Conditions for Coaching Services

By purchasing Coaching Services from Pathfolk these Terms and Conditions are agreed to on the date purchased between the purchaser (“Client”) and Molly Leis (“Coach”) and referred jointly as “Parties”  for the duration of the coaching relationship both consecutively and intermittently. These Terms and Conditions govern the agreement between Pathfolk ('Molly Leis') and the individual or entity ('Client') engaging in coaching services."

By participating in our coaching programs, you agree to the terms outlined below, which detail the responsibilities, expectations, and legal rights of both parties."

Please read these terms carefully, as they set the foundation for our professional relationship and ensure mutual understanding and respect throughout our engagement.

Coaching Relationship and Commitment Coaching is for individuals who choose intentional changes to improve their lives. It establishes an ongoing, transparent, and trusting relationship between the Coach and Client.

The coaching process is designed to help change mindsets, routines, and habits, creating new possibilities and behaviors through sustained, long-term practice. The Coach and Client will collaborate to design a relationship to meet the Client’s unique needs and goals. Because progress and change occur at individual rates, both the Coach and Client commit to working together during the duration of the coaching engagement. This commitment allows the coaching relationship to evolve, addressing challenges and achieving objectives. The Client commits to engaging fully in the process, embracing learning opportunities for effective and sustained development.

Coaching Services. To understand and clarify Coaching Services, the Parties acknowledge and agree that: 

  1. Coach facilitates the process of personal and professional development, which includes interpersonal communication, body language, emotional awareness and management, and relationship management with other people across teams, groups, organizations, businesses, ecosystems, industries, etc.

  2. Coaching is a relationship designed and defined by Client to meet Client’s stated lawful interests, goals,  and objectives. Both Parties understand these may change during the coaching relationship. The Coach and Client will clearly outline goals and understand that these goals may evolve and that the coaching process is also flexible. Coaching is adaptable to the changing needs of the client.

  3. Coach uses discussion, questions, and requests to assist Client as Client identifies personal and/or professional goals, develops strategies and action plans intended to achieve such goals, and monitors progress towards implementation of follow-on actions. 

  4. Coach mirrors what Client perceives the world to be with a focus toward the future and, through a  didactic dialogue, enables Client to explore and discover possibilities, alternatives, and blind spots Client may have otherwise overlooked. 

  5. Client is responsible for his/her/their own achievements and success, and Coach is responsible for providing honest feedback and observations based on Coach’s own life experiences and studies to Client.

  6. Coaching is not financial, investment, legal, or medical advice, therapy, or counseling regardless of the situations the Client may be experiencing and challenges the Parties may discuss together.  

Coaching Session Procedures. All coaching sessions are conducted via telephone or via the preferred virtual platform link, e.g., Zoom or Google Meet, provided by the Client or Coach. At the scheduled date and time, Client will call Coach for a collaborative coaching session from a quiet location without distractions. Coach and Client commit to starting and finishing each session on time.  If Client is more than ten (10) minutes late for a coaching session without prior communication, Coach will assume the session is cancelled. 

Coaching Timeline. When Client purchases multiple coaching sessions, then the series of calls will be structured as follows: 

• First Session: The first session will be 90 minutes including review of any assessments that may have been completed and establishing the focus of the coaching series. If time remains, the Coach and Client will begin the coaching process. 

• Multiple Sessions: When Client purchases multiple coaching calls, Coach and Client will design the series of sessions to identify Client’s specific challenges and desired outcomes. Between coaching sessions, Client may e-mail Coach regarding coaching-related questions and issues. Communication between the scheduled coaching sessions is permissible via email only on an as-needed basis to achieve goals and based on Coach’s availability to respond within 48 hours; the Parties agree to keep the emails related to coaching.

Modifications to Scheduled Coaching Sessions. Client agrees to directly reschedule or change coaching sessions no later than 24 hours prior to each coaching session via Coach’s scheduling technology, i.e., Calendly.  Requests for the cancellation or rescheduling of previously scheduled coaching sessions shall require 24 hours advance notice by Client to Coach. If such notice is provided, or in the event of Coach’s need to reschedule,  Coach shall make every effort to reschedule the appointment for a mutually acceptable time (if rescheduling is desired by Client). In such cases, should Client desire to cancel the appointment, or should the Parties be unable to agree upon an alternative date and time to reschedule the appointment, no fee will be charged for that session.  

Coaching Models and Subjects: For executive and leadership competency development, the use of models and frameworks will be tailored to the client’s needs. Client understands that Coach may use the Transform Model, the Pathfolk Mindful Leadership Model or some of the following additional frameworks: CLEAR Model, Transactional Analysis, Parallel Processing, Coaching Constellations, Somatic Coaching & Leadership Embodiment, Fields of Conversations, Emotional Intelligence, Transpersonal perspective, Gestalt Principles 2 Chair, Mindfulness & Meditation and Theory U.

Coaching sessions may include the following key subject areas of:  Resilience Mental Health Awareness, Mental Wellbeing, Conscious Communication, Effective Leadership, Mindful Meetings, Finding Purpose, Belonging, People Management.

These subject areas are based on Coach’s extensive research, experience, and expertise in resilience and mental fitness for organizations across for-profit and non-profit sectors,  countries, and continents. Coach may use his startup model to support the development of Client. If Client uses elements of Coach’s startup model beyond the coaching relationship, then Client will provide proper attribution to  Coach and his startup model in perpetuity. Coach does not grant any license to Client for perpetual use.  

Handling Technical Issues During Virtual Sessions

To ensure smooth virtual coaching sessions, it is important to prepare in advance. Before the session begins, test your equipment, including your computer, microphone, camera, and internet connection. Make sure that your virtual meeting platform, such as Zoom or Google Meet, is updated to the latest version. Additionally, verify that you have a stable internet connection and consider having a backup, such as a mobile hotspot, in case of connectivity issues.

During the session, if a technical issue arises, both parties should attempt basic troubleshooting steps. This may include reconnecting to the call, restarting the application, or switching to a different device. If these steps do not resolve the problem, use a backup communication method, such as email or phone, to inform each other and coordinate immediate actions.

If technical problems persist and cannot be resolved within the first 10 minutes, both the Coach and Client should agree to reschedule the session. To reschedule, use the agreed-upon scheduling platform, such as Calendly, and promptly notify each other of the new proposed date and time.

It is also helpful to have a backup plan in place. If issues occur with the primary virtual meeting platform, consider using an alternative platform or switching to a phone call. Ensure that both parties have each other’s phone numbers or another means of contact to handle any technical difficulties.

Finally, keep a brief record of any technical issues and the steps taken to resolve them. This documentation can help in identifying recurring problems and improving the overall experience for future sessions. By following these guidelines, both the Coach and Client can minimize disruptions and maintain a professional and effective coaching experience.

Fees & Refunds. Beginning with October 2024 sessions, Client will pay Coach the coaching fee one-time, in advance in USD described via designated payment links provided by Coach. Client will use Coach’s payment links for subsequent coaching session purchases. No-shows will not receive refunds. If Client ends a coaching session during a call at any time for any reason, no refunds will be issued. For multiple coaching sessions purchased in advance, any cancellation of unused sessions will incur a  20% refund surcharge of the total per session fee. Refunds are not available for coaching sessions purchased at the promotional rate before January 15, 2024.

Confidentiality. The coaching relationship is built on trust. Coach agrees to keep all conversations and information with Client private and confidential. No personal ideas, information, or thoughts expressed during coaching sessions will be shared with anyone except with permission of Client. Coach acknowledges he may obtain confidential personal and/or business information from Client and agrees to keep and maintain such information strictly confidential and not to disclose or use such information without Client’s prior written consent. Client grants express permission for Coach to use Client’s business/organization name and logo only on Coach’s website and lists for marketing and promotion purposes. 

Release of Information. Client acknowledges and agrees that, exclusively for purposes of application for  professional credentials, Coach may provide to the International Coach Federation, the following, and only the following, information regarding services delivered under these terms: Client’s name, Client’s telephone number and/or email address, the start and end dates of the coaching engagement, and the total number of hours of  coaching sessions delivered. Client agrees to be contacted by authorized representatives of the International  Coach Federation, at their sole discretion, exclusively for verification of such submitted information; no questions about content of coaching will be asked. 

Waiver. Client acknowledges and agrees that during Coaching Services, the Coach may ask questions that are personal, challenging, or potentially disturbing. The Client waives and releases any claims arising from such questions, actions, or services provided by the Coach, except for breaches of confidentiality by the Coach. Additionally, if the Coach believes that the Client is in danger of harming themselves or others, the Coach reserves the right to breach confidentiality to ensure safety.

Warranty. Coach does not implicitly or explicitly provide any warranty at any time for any services rendered. Coaching Services are not therapeutic, medicinal, financial, or legal in nature. Client is fully responsible for the outcome, or lack thereof, of Coaching Services.

Modifications Any modifications to these Terms and Conditions must be made in writing and signed by both the Coach and Client to be effective.

Entire Agreement These Terms and Conditions constitute the entire agreement between the Coach and Client regarding the coaching services and supersede all prior agreements and understandings, whether written or oral, related to such services.
